मजीठिया वेज बोर्ड देने में आनकानी करने वाले जो अखबार अपने कर्मचारियों से जबरन इकरारनामा लिखवा रहे हैं कि उन्हें वेज बोर्ड नहीं चाहिए, वे वर्किंग जर्नलिस्ट (फिक्शेशन आफ रेट्स आफ वेजेज) एक्ट 1958 की धारा 7 का उल्लंधन कर रहे हैं।
मजीठिया वेज
बोर्ड की नोटिफिकेशन में सेक्शन 20जे के तहत कर्मचारियों द्वारा नया वेतनमान
देने से इनकार करने की जो आप्शन मौजूद है, वह मौजूदा वेज बोर्ड के तहत बनने वाले वेतन से अधिक वेतन व भत्तों के संबंध
में हो सकती है,
न कि कम वेतन को
लेकर। लिहाजा अगर जो भी कोई कर्मचारी आपने अखबार प्रबंधन के दबाव के चलते ऐसा
इकरारनामा लिखने को मजबूर हुए हैं, उन्हें डरने की
जरूरत नहीं है,
क्योंकि इस
प्रावधान की कानूनी वैधता ही नहीं है। कोई भी वेज बोर्ड वर्किंग जर्नलिस्ट एक्ट,1955 के प्रावधानों के खिलाफ अनुशंसा नहीं कर सकता
है। अगर ऐसा हुआ भी है,
तो इसकी वैधता
को चैलेंज किया जा सकता है और यह वर्किंग जर्नलिस्ट (फिक्शेशन आफ रेट आफ वेजेज)
एक्ट 1958
की धारा सात का
उल्लंघन है।
वर्किंग
जर्नलिस्ट (फिक्शेशन आफ रेट आफ वेजेज) एक्ट की धारा सात में स्पष्ट लिखा गया है कि
कोई भी अखबार प्रबंधन वर्किंग जर्नलिस्ट एक्ट की धारा 9 व 13सी के तहत गठित वेतन आयोग की सिफारिशों के तहत लागू किए गए वेतनमान से कम वेतन
नहीं दे सकता। ऐसे में धारा सात के खिलाफ किया गया किसी भी पत्रकार या गैर-पत्रकार
कर्मचारी का इकरारनामा या हलफनामा स्वत: ही वैधता खो देता है।
इस एक्ट की धारा
11
में भी स्पष्ट
किया गया है कि श्रमजीवी पत्रकार व गैर पत्रकार कर्मचारी अपने न्यौक्ता के साथ
वहीं समझौता करने को स्वतंत्र होगा, जो उसे वेज बोर्ड के प्रावधानों से ज्यादा लाभ देता हो।

Section
7. Working journalists entitled to wages at rates not less than
those
specified in the order.- Subject to the provisions contained in
section
11, on the coming into operation of an order of the Central
Government,
every working journalist shall be entitled to be paid by
his
employer wages at a rate which shall in no case be less than the
rate
of wages specified in the order.
Section
11. Effect of Act on Working Journalists Act, etc.- (1) Sections
8,
10, 11, 12 and 13 of the Working Journalists Act shall have no
effect
in relation to the Committee.
(2)
The provisions of this Act shall have effect notwithstanding
anything
inconsistent therewith in the terms of any award, agreement
or
contract of service, whether made before or after the commencement
of
this Act:
Provided
that where under any such award, agreement, contract of
service
or otherwise, a working journalist is entitled to benefits in
respect
of any matter which are more favorable to him than those to
which
he would be entitled under this Act, the working journalist
shall
continue to be entitled to the more favorable benefits in
respect
of that matter, notwithstanding that he receives benefits in
respect
of other matters under this Act.
(3)
Nothing contained in this Act shall be construed to
preclude
any working journalist from entering into any agreement with
an
employer for granting him rights or privileges in respect of any
matter
which are more favorable to him than those to which he would
be
entitled under this Act.
