दैनिक दिव्य मराठी को सुप्रीम कोर्ट से झटका!

 औरंगाबाद हाईकोर्ट का स्टे आॅर्डर बरकरार !!

जस्टिस मजीठिया वेज बोर्ड मामले में डी.बी. कॉर्प को सुप्रीम कोर्ट ने एक झटका दिया है। महाराष्ट्र के औरंगाबाद में डी.बी. कॉर्प के समाचार पत्र दैनिक दिव्य मराठी के मीडियाकर्मियों के  अदालत में जमा पैसे को निकलाने पर बांबे हाईकोर्ट की औरंंगाबाद खंडपीठ द्वारा लगाई गई रोक को माननीय सुप्रीमकोेर्ट ने अगली तिथि तक बरकरार रखा है।  माननीय सुप्रीमकोर्ट की डबल बेंच ने 13 फरवरी 2023 को जारी अपने आदेश में दिव्य मराठी (डीबी कॉर्प) को औरंगाबाद उच्च न्यायालय में जमा 97 लाख 20 हजार 341 रुपये की राशि निकालने पर रोक लगा दी है (मूल रूप से यह राशि आधी ही है, आधी राशि अभी भी दिव्य मराठी के पास शेष है।  दैनिक दिव्य मराठी के कर्मचारियों की ओर से वरिष्ठ अधिवक्ता सुधांशु चौधरी ने जोरदार तर्क दिया और कहा कि  औरंगाबाद हाईकोर्ट ने तकनीकी आधार पर ही आदेश पारित किया है। मेरिट चेक नहीं हुई। इसके विपरीत, इलाहाबाद उच्च न्यायालय ने दृढ़ता से तर्क दिया था  कि योग्यता के आधार पर निर्णय देकर तकनीकी आधार को खारिज कर दिया गया है। डी. बी. कॉर्प के वकील ने तर्क दिया कि राज्य सरकार श्रम पत्रकार अधिनियम की धारा 17 (2) के तहत अपनी शक्तियों को किसी दूसरे को नहीं दे सकती। राज्य सरकार द्वारा बिना अधिकार के 11 मई 2016 को जारी की गई अधिसूचना अवैध है और नागपुर खंडपीठ द्वारा पारित आदेश सही है, मामले को खारिज किया जाना चाहिए। इस पर न्यायाधीश ने कंपनी के वकील से कहा कि चूंकि यह मामला राज्य सरकार का है, इसलिए वे मामले पर उनकी राय सुने बिना कोई आदेश पारित नहीं कर सकते।उसके बाद डी. बी. कॉर्प के वकील ने औरंगाबाद पीठ से सुधीर जगदाले और टीम का बकाया अदालत में जमा पैसा वापस लेने की अनुमति मांगी।  मीडियाकर्मियों  के वकील सुधांशु चौधरी , महेश शिंदे, वात्सल्य वैग्य और प्रशांत जाधव ने इसका कड़ा विरोध किया और स्थगन पर जोर दिया। इस पर माननीय सुप्रीम कोर्ट की डबल बेंच के न्यायमूर्ति दिनेश माहेश्वरी और दीपांकर दत्ता ने अगली तारीख तक स्थगन आदेश पारित किया और प्रतिवादी को नोटिस तामील करने का आदेश दिया।

Journalists Thank Dr Sivadasan for Raising the Issue of Journalists in the Parliament

New Delhi, 11 Feb. A delegation of the Indian Federation of Working Journalists (IFWJ) today met the CPI(M) Member of Parliament Dr V Sivadasan here and thanked him for raising the wage board issue of journalists in the Rajya Sabha.  Dr Sivadasan had asked the government about the number of journalists working in print, electronic and online media industry-wise. He also wanted to know what the stage of the constitution of the wage board was and whether the journalists were getting their wages as per the recommendation of the wage board. It is regrettable that on all counts the government has not been able to furnish any convincing reply.

A few years ago, when a similar question was asked about the implementation of the Majithia wage award, the then Labour Minister Santosh Gangwar had replied that some four hundred sixty newspapers had implemented the wage board award but the figure was nowhere near the reality. In fact, even now hardly any newspaper has fully implemented the award. Some twenty thousand newspaper employees have been thrown out of jobs across the country and their only fault has been that they demanded wages according to wage board recommendations from their owners.

The Working Journalist Act covers only print media journalists and non-journalist employees. Those working for Electronic and Web media are not covered under the Act, therefore their wages and other facilities depend on the whims and fancies of the media owners. In some media organisations, the condition of employees is very pathetic, and they are subjected to the worst kind of exploitation. Dr Sivadasan assured the IFWJ delegation that he and his party would continue to support the cause of the working class, but he said that it would gain momentum only when the media persons themselves came forward and led the struggle.

Dr Sivadasn had a lengthy discussion with the delegation about the state of the media industry in the country. He expressed his disappointment that the media employees have, by and large, not been taking part in the struggle of the working class. Among those included in the delegation were Indian Federation of Working Journalists (IFWJ)  Secretary General Parmanand Pandey, Alkshendra Singh Negi and Vivek Tyagi, the President and the General Secretary of the Delhi Union of Working Journalists (DUWJ) respectively and Mahesh Kumar.
