Resolution passed in CWC at Vishakhapattanam


This Central Working Committee of All India Newspaper Employees Federation, New Delhi, held at Vishakhapattanam (AP) on 22-23rd October 2016 after extensive and exhaustive deliberations unanimously resolves –

On implementation of Awards

          (1)     That in the light of the recommendations in Palekar Award (1979), Bachawat Award (1988), Manisana Award (1998), Majithia Award (2011) if the management of a Newspaper Establishment has failed to comply with any recommendation/s Unions should raise an industrial dispute

(a)     for implementation of the said recommendation/s by asking the management to produce relevant Balance Sheets to verify the same for purposes of determination of its gross revenue and class thereof;

(b)     for fixation in scales of pay provided for in the Award/s for relevant class of Newspaper Establishment and also for grant of appropriate increments and/or benefits provided for in the Award/s;

(c)     that this action of the Unions will be in addition to contempt proceedings, if any, filed by it or individual employees and without prejudice to the same but in addition to it;

On Alarming Increase in Employment on Contract Basis

          (2)     That in the light of the growing unfair labour practices on the part of the Newspaper Establishments to engage both journalist and non-journalist employees on contract basis, so as to deny these employees benefits of regularization and permanency and various awards and also other related labour laws, by keeping these employees perpetually on tenterhooks of uncertainty and condemning them to life of humiliation, subjugation and servitude is a blatant violation of Human Rights and other legal rights.  This meeting, therefore, strongly condemns indulgence of Newspaper Establishments in these unfair labour practices and;

(a)     calls upon the Newspaper Establishments to refrain from such unfair labour practices and to regularize services of all journalist and non-journalist employees, who are presently working on contract basis, and to pay them all the benefits of regular and permanent employees, including benefits of various Awards with retrospective effect;

(b)     calls upon the Unions to enroll all such journalists and non-journalist employees, who are committed to abolition of such system of employment on contract basis, and actively help them liberate from this abhorrent method of exploitation and degradation of continually working on contract basis;

(c)     calls upon the Unions to do everything in their power to strengthen both numerically and qualitatively the system of employing employees on regular and permanent basis and to ensure filling up of all vacancies on that basis.

ON CLANDESTINE JOBS ELLMINATION & REDUCTION OF EMPLOYMENT OPPORTUNITIES

          (3)     That looking to the growing resort of Newspaper Establishments to unfair labour practices of outsourcing for jobs elimination and continuous application of systems of rationalization and automation, resulting in increasing workload and sapping of energy and strength of employees to perilous level, resulting ultimately in reduction of employment opportunities as well, this Central Working Committee meeting, therefore,

(a)     calls upon the Unions to identify and oppose all overt and covert methods of outsourcing aimed at reducing regular and permanent jobs to the disadvantage of the employees;

(b)     calls upon the Unions to identify and oppose each and every step/decision of rationalization and automation which is likely to lead to retrenchment of employees and/or saddles them with additional workload without corresponding or commensurate benefit thereof.

This Central Working Committee of the All India Newspaper Employees Federation expects every union to devise its own peaceful and constitutional methods and use all or any peaceful trade union ways and means, in keeping with its strength and given capacity, depending on the local conditions and the willingness of the members to traverse the distance and to implement the Resolution accordingly.  With this the Central Working Committee feels success is assured, may be in stages and at a slower rate.

          In case of difficulties, President of the All India Newspaper Employees Federation will be available for guidance and help.
