The
Labour Commissioner of Uttarakhand Dr. Anand Srivastava has profusely
apologized to the Hon’ble Supreme Court of India for not appearing on the last
date of hearing of the Majithia case on 23rd August 2016. In a
sworn affidavit filed in the Supreme Court he has said that it has happened
because of the inadvertent misunderstanding as he was under the impression that
the Labour Commissioner has to be represented through the counsel.
It
may be mentioned here that on the previous date of 19th July
2016, the court had directed the Labour Commissioners of Uttar Pradesh,
Uttarakhand, Himachal Pradesh, Nagaland and Manipur to be personally present in
the Court room to reply to the queries on the Status of the implementation of
the Majithia Award. While the Labour Commissioners of other four states were
present along with their respective counsel there was none from the
Uttarakhand. To uphold the majesty of law the Hon’ble Court consisting of the
Justice Ranjan Gogoi and Justice P.C. Pant had to issue a bailable warrant of
arrest against the Labour Commissioner of Uttarakhand to ensure his presence on
the next date of hearing with the details which have been asked by the court to
be furnished.
The
Labour Commissioner, Dr. Srivastava, while tendering the unconditional apology
to the court has promised to be more vigilant and attentive in future. He said
that he has put in eleven years of service with career record and has always
complied with the directions of all courts. In view of his future service
career he has, therefore, prayed to the court to recall its order of warrant of
arrest for non-appearance.
